Terms of Service

This document is a public offer (user agreement) that sets out the terms of using Harbr Four ("Service") — the Telegram bot and web panel at harbr4.com that connect seafarers and crewing companies.

By registering in the bot or on the website, you accept the terms of this agreement.

1. Parties

The Service is operated by an individual (Ukraine), referred to as the "Owner". A User is anyone who registers in the bot as a seafarer or as a representative of a crewing company.

2. Subject of the agreement

The Owner provides access to a platform for finding vacancies (for seafarers) and finding candidates (for crewing companies). The Service is not a recruitment agency, does not guarantee employment, and is not a party to the employment relationship between a seafarer and an employer.

3. Registration

To use the Service you must register through the Telegram bot and provide accurate profile data. The Owner may restrict access if inaccurate data is detected.

4. User obligations

• Provide accurate profile and vacancy data
• Don't use the Service to send spam, fraudulent vacancies, or collect data outside the platform
• Don't abuse the application / auto-apply feature (fake applications, bots)

5. Service limitations

A seafarer cannot cancel a submitted application — this protects crewing companies from fake or inflated application counts. The Owner may limit the number of active vacancies and applications within each plan.

6. Moderation

The Owner may reject or remove a vacancy, profile, or account that violates this agreement or contains knowingly false information.

7. Disclaimer

The Service is provided "as is". The Owner does not guarantee employment, the accuracy of third-party vacancies, or uninterrupted bot operation.

8. Limitation of liability

To the extent permitted by law, the Owner of the Service is not liable for indirect losses, lost profits, or the outcome of any deal between a seafarer and a crewing company made through the platform. Total liability is limited to the amount the user paid for the Service over the last 3 months.

9. Personal data

Data processing is described in the Privacy Policy, which is an integral part of this agreement.

10. Termination

You can delete your account at any time via the bot. We may restrict access if you violate the terms of this agreement.

11. Changes to these terms

These terms may be updated; the current version is always published at harbr4.com. We'll notify you of material changes via the bot.

12. Governing law

This agreement is governed by the laws of Ukraine.

Цей документ є публічною офертою (користувацькою угодою) і визначає умови використання сервісу Harbr Four («Сервіс») — Telegram-бота та веб-панелі на harbr4.com, що з'єднують моряків і крюїнгові компанії.

Реєструючись у боті або на сайті, ви приймаєте умови цієї угоди.

1. Сторони

Сервіс керується фізичною особою (Україна), далі «Власник». Користувач — будь-яка особа, що зареєструвалась у боті як моряк або представник крюїнгової компанії.

2. Предмет угоди

Власник надає доступ до платформи для пошуку вакансій (для моряків) і пошуку кандидатів (для крюїнгових компаній). Сервіс не є кадровим агентством, не гарантує працевлаштування і не є стороною трудових відносин між моряком і роботодавцем.

3. Реєстрація

Для використання Сервісу необхідно зареєструватися через Telegram-бота та надати достовірні дані профілю. Власник вправі обмежити доступ у разі виявлення недостовірних даних.

4. Обов'язки користувача

• Надавати достовірні дані профілю та вакансій
• Не використовувати Сервіс для розсилки спаму, шахрайських вакансій або збору даних в обхід платформи
• Не зловживати функцією відгуків/авто-відгуку (накрутка, боти)

5. Обмеження сервісу

Моряк не може скасувати надісланий відгук — це обмеження захищає крюїнгові компанії від накрутки заявок. Власник вправі обмежувати кількість активних вакансій і відгуків у межах тарифних планів.

6. Модерація

Власник вправі відхилити або видалити вакансію, профіль чи акаунт, що порушує умови цієї угоди або містить завідомо неправдиву інформацію.

7. Відмова від гарантій

Сервіс надається «як є». Власник не гарантує працевлаштування, достовірність вакансій третіх осіб чи безперебійну роботу бота.

8. Обмеження відповідальності

У межах, дозволених законом, Власник Сервісу не несе відповідальності за непрямі збитки, втрачену вигоду або наслідки угод між моряком і крюїнгом, укладених через платформу. Сукупна відповідальність обмежена сумою, сплаченою користувачем за Сервіс за останні 3 місяці.

9. Персональні дані

Обробка даних описана в Політиці конфіденційності — невід'ємній частині цієї угоди.

10. Припинення використання

Ви можете видалити акаунт у будь-який момент через бота. Ми можемо обмежити доступ у разі порушення умов цієї угоди.

11. Зміни умов

Умови можуть оновлюватися; актуальна версія публікується на harbr4.com. Про суттєві зміни повідомимо через бота.

12. Застосовне право

Угода регулюється законодавством України.
